The petitioner seeks bail in connection with Kotwali (Jogsar) P. S. Case No. 1094 of 2019 dated 14.12.2019, instituted for offences under Sections 411, 413, 414 and 401 of the Indian Penal Code.

Patna High Court CR. MISC. No.34538 of 2020(2) dt.22-12-2020 2/3 It appears from the F.I.R. that the house of the petitioner was raided and from there, three allegedly stolen motor-cycles were recovered.

The learned counsel for the petitioner in the first instance submitted that the seizure list contains the signature of only the member of the raiding party and none of the family members of the petitioner. He next contended that there is no report about anyone of the stolen motor-cycles and nobody has come forward to claim the motor-cycle to be his.

In fact, the learned counsel for the petitioner has submitted that the recovery has been made from outside the house but wrongly, the recovery has been saddled on him.

The petitioner is in custody since 14.12.2019 and he is a person of clean antecedents.

Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs.

Patna High Court CR. MISC. No.34538 of 2020(2) dt.22-12-2020 3/3 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Kotwali (Jogsar) P. S. Case No. 1094 of 2019.

The petition stands allowed.
