The petitioner seeks bail in connection with Jalalgarh P.S. Case No. 83 of 2020, dated 11.06.2020, instituted for the offences under Sections 363, 366(A) and 376 of the Indian Penal Code and Section 4 of the Protection of Children

Patna High Court CR. MISC. No.34518 of 2020(3) dt.10-02-2021 2/3 from Sexual Offences Act, 2012.

The victim girl, after her recovery, has got her statement recorded under Section 164 of the Cr.P.C. in which, she has stated that she had gone with the petitioner of her own volition. She has also clarified in the aforesaid statement that she had intended to marry the petitioner, but only because of the opposition of her family, the marriage could not be performed. The victim girl disclosed her age to be 18 years in the aforesaid statement.

The petitioner is stated to be in custody since 18.06.2020.

Considering the period of custody of the petitioner and the statement of the victim girl under Section 164 Cr.P.C., the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District
