JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Jokihat P.S. Case No. 234 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 326, 307, 353, 379, 427, 504 and 506 of the Indian Penal Code. Prosecution case is that one Sanjay Kumar Sah received injuries and he was brought to the Primary Health Centre and thereafter he was referred to the Sadar Hospital, Araria and it is alleged that petitioners and several other accused persons came variously armed and started assaulting the Doctor and also damaged public property and snatched cash from the pocket of the Doctor. Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the petitioners, they have clean antecedent and charge sheet in this case has been filed and

Patna High Court CR. MISC. No.38261 of 2019(3) dt.02-09-2019 2/2 there is no chance of absconding of the petitioners and they are ready to abide by any condition that may be imposed on them. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Jokihat P.S. Case No. 234 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioners have to co-operate in the investigation, otherwise bail bonds of the petitioners shall be cancelled.
