In view of the fact that the present application is not maintainable on account of the Section 77 of the Bihar Registration Act, 1908 which clearly provides for initiation of a suit in case of order of refusal by the Registrar to register any deed, this Court finds that the present application is not maintainable.

Moreover, the petitioner has failed to implead the District Registrar-cum-Collector, Vaishali as a party. Thus, the application also suffers for non-joinder of necessary parties.
