The petitioners seek bail in anticipation of their arrest in connection with Sheikhpura P.S. Case No. 60/2020 instituted for the offences under Sections 436, 427, 341, 323, 504 and 506/34 of the Indian Penal Code. The petitioners are alleged to have set on fire the cattle house of the informant leading to the burn injuries on a cow and a calf and damage to certain properties. Patna High Court CR. MISC. No.35981 of 2020(2) dt.26-03-2021 2/2 submitted that they are directly related to the informant and because of some dispute over possession of land, they have been made accused in this case. There is no eye witness to the occurrence and the prosecution of the petitioner is only on the basis of suspicion against them.

Regard being had to the nature of accusation and the relationship between the parties, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case No. 60/2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
