The petitioners seeks bail in a case registered under Sections 429, 153(A), 295(A), 420, 468, 471, 120(B)/34 of the Indian Penal Code and Section 11 of Prevention of Cruelty to Animals Act, 1960, Section 345 r/w 429 of Bihar Municipal Act, 2007 and Section 79 of Police Act.

Allegedly, the truck laden with huge quantity of cow beef and cow skin was seized. Some mobile phones and cash were also recovered from driver and cleaner (petitioners) of the truck. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.41420 of 2019(2) dt.05-07-2019 2/2 petitioners. The petitioners are in custody since 05-03-2019. Charge sheet has already been submitted. Petitioners are alleged to be driver and cleaner of the truck, in question. They are not owner of the goods in question. The goods were booked for transportation by the co-accused Sri Raj Kumar. The goods were to be supplied to N.S. Leathers, Kolkata. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 23-05-2019 passed in Cr. Misc. No. 33957 of 2019.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No. 114 of 2019.
