2. The petitioner is apprehending his arrest in a case in connection with Guthani P.S. Case No. 61 of 2025 dated 04.03.2025 registered for the offences punishable under Section 25(1)(a) of the Arms Act.

As per the prosecution case, on 04.03.2024 at around 7:30 PM, a video went viral on social media showing illegal arms being displayed during an orchestra event at a wedding on the night of 02.03.2025 in Dhoomnagar. In the video, the co-accused Abhishek Paswan and Aman Rawat were seen dancing with illegal weapons. Upon investigation, both

Patna High Court CR. MISC. No.36066 of 2025(2) dt.02-07-2025 2/3 were arrested from their homes. They admitted that the video was of them and the weapons were theirs. The co-accused, Abhishek Paswan revealed that the large weapon belonged to Yusuf Ali (petitioner) and two pistol belongs to Robin Singh. A raid at their houses was conducted, but both were absconding.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and due to previous enmity he has falsely been implicated in this case. As per para-9 of the bail petition, it is submitted that neither arms have been recovered from the conscious possession of the petitioner nor he is licensee of any fire arms. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Siwan in connection with Guthani P.S. Case No. 61 of 2025,

No.36066 of 2025(2) dt.02-07-2025 3/3 subject to conditions as laid down under section 482(2) of the B.N.S.S., with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.

7. The application stands allowed.
