2. Learned counsel for the petitioner submits that earlier the prayer for anticipatory bail of the petitioner has been rejected by this Court vide order dated 18.01.2024 in Cr. Misc No. 83648 of 2023.
3. Learned counsel for the petitioner submits that the coaccused, in whose confession the name of the petitioner was figured, has been acquitted. His further submission is that the anticipatory bail of the petitioner was rejected as he remained absconding during period of investigation and the case was lingered for a considerable long duration due to his absconding. He further submits that the petitioner remained in custody since 7.3.2024 and he has amply been punished for his absence. The charge-sheet has been submitted as

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S. Case No. 476 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) SONALI/- U T
