2. The petitioner apprehends his arrest in connection with Bihiya P.S. Case No. 94 of 2025, registered for the offences punishable under Section 137(2) of BNS.
3. The allegation of kidnapping of 17 years old sister of the informant is on co-accused Sumit Mishra. It has been mentioned in last portion of the FIR that the petitioner assisted the Sumit Mishra in kidnapping the sister of the informant.
4. The learned counsel for the petitioner has submitted that as a matter of fact, the victim had love and affection with co-accused Sumit Mishra and she has solemnized marriage with
Patna High Court CR. MISC. No.40361 of 2025(2) dt.08-09-2025 2/2 him. The petitioner is maternal brother of the main accused Sumit Mishra and that is why he has been implicated in this case.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Bihiya P.S. Case No. 94 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
