====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Kajra P. S. Case No. 98/2020 in a case registered for the offence punishable under Sections 121, 120B/34 of the Indian Penal Code, Section 25(1-b)a, 26, 35 of Arms Act and Section 3/4 of the Explosive Substances Act.
3. As per the prosecution case, on secret information that some miscreants had assembled for committing some crime, a raid was conducted and one co-accused Monu Kumar was apprehended from whose possession huge quantity of arms and ammunition were recovered. Co-accused Monu Kumar disclosed the name of this petitioner and 36 other accused
Patna High Court CR. MISC. No.35802 of 2025(2) dt.18-07-2025 2/2 persons, who fled away after seeing the police.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Name of this petitioner transpired only on the basis of confessional statement of co-accused, who was apprehended on the spot. No arms and ammunition has been recovered from possession of the petitioner. It is further submitted that similarly situated coaccused persons have already been granted bail by co-ordinate Benches of this Hon'ble Court. Petitioner claims clean antecedent. Petitioner is in custody since 16.11.2024.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Lakhisarai in connection with Kajra P. S. Case No. 98/2020.
