JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This application, for grant of anticipatory bail, arises out of Muffasil P.S. Case No. 87/2019, disclosing offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016. Prosecution case is that the police on information that the accused persons are manufacturing, raided the Sadha Chowr and on seeing the police, petitioner and other accused persons started fleeing away and, thereafter, recovery of 120 litres of liquor was made.
Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of disclosure made by the co-accused person and except that there is nothing against him and he has no criminal antecedent. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. IXth -cum- Special Judge, Saran at Chapra, in connection with Muffasil P.S. Case No. 87/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
