JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-03-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 406, 420, 467, 468, 471, 384, 120B, 504 and 506 of the Indian Penal Code.
It is alleged that the informant being the proprietor-cumdirector of A.M.K. Films entered into the agreement with the petitioner for production of his film "Sadak Chhap Admi". The petitioner agreed to invest `10 lacs. In pursuance to the agreement, the informant received `55,000/- and thereafter rest amount was not paid subsequently the informant demanded further money when he was threatened and assaulted.

No.12355 of 2015 (2) dt.25-03-2015 2/2 It is submitted by learned counsel for the petitioners that the accusation has been levelled in the background of dispute with regard to contractual relationship between the petitioner and informant. The informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-2 to the petition. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari in connection with Motihari Town P.S. Case No. 430 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
