JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-07-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Garkha P.S. Case No. 265 of 2020, registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. The learned counsel for the petitioner has submitted that the anticipatory bail of Krishna Rai and petitioner Ramjhari Devi was rejected vide order dated 07.03.2022 in Cr. Misc. No. 11552 of 2021. He has submitted further that fresh ground for filing of anticipatory bail petition is that Krishna Rai, who is devar of the deceased as well as husband (Munna Rai @ Munna Kumar) of the deceased has been acquitted in Sessions Trial No. 411 of 2022, vide order dated 03.01.2023 and the petitioner is

Patna High Court CR. MISC. No.42084 of 2023(2) dt.26-07-2023 2/2 mother-in-law of the deceased, whose case is on better footing. He has also submitted that the witnesses did not support the prosecution's case during the trial.

Considering the above-mentioned facts and circumstances as well as the fact that the witnesses during trial of other accused persons did not support the prosecution case, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist, Class, Saran at Chapra in connection with Garkha P.S.
