Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 465, 467, 468 and 471 of the Indian Penal Code. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 26-8-2023, examination by B.P.S.C for employment of teachers was conducted and the bio-metric of the candidates was done, further the bio-metric of the petitioner did not match.

Learned counsel for the petitioner submits petitioner has been falsely implicated in the instant case. It is next submitted that petitioner never appeared in the examination

Patna High Court CR. MISC. No.40068 of 2024(2) dt.13-08-2024 2/2 as such he is not aware that how his name figured in the FIR, when he was not even an applicant for the said examination. It is also submitted that petitioner will not abscond rather will cooperate in the investigation.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Alamganj P.S. Case No. 778 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

One of the bailors of the petitioner shall be his brother, Randhir Kumar.
