JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Hathauri P.S. case No. 97 of 2012 registered under Section307 & other minor sections of the Indian Penal Code. No doubt, the petitioner happens to be full brother of the informant but there is accusation against him that he assaulted the informant's wife as well as other brothers with spade causing grievous injuries to them.

Although the wife of the petitioner has lodged Hathauri P.S. case No. 98 of 2012 but taking note of the above-said facts as well as nature of injuries, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, prayer for

Patna High Court Cr.Misc. No.33986 of 2014 (2) dt.10-02-2015 2/2 anticipatory bail of the petitioner in connection with Hathauri P.S. case No. 97 of 2012 pending in the court of Additional Chief Judicial Magistrate, Rosera, Samastipur stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
