JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-02-2021 Heard Mr. Abhishek Kumar, learned counsel for the petitioner and Mr. Sanjeev Kumar for the informant. The State is represented by Mr. Ram Priya Sharan Singh, the learned APP for the State.
The petitioner seeks bail in connection with Mainatand P.S. Case No. 92 of 2020 dated 08.06.2020 instituted for the offences under Sections 341, 323, 324, 325, 307, 379, 504 and 34 of the Indian Penal Code.
He is the own brother of the informant and is alleged to have assaulted the informant as well as another who is his nephew.
Learned counsel for the informant has opposed the prayer for bail on the ground that the injuries
Patna High Court CR. MISC. No.34569 of 2020(3) dt.17-02-2021 2/2 suffered by the victim are grievous in nature. Though both the victims have suffered one and two grievous injuries respectively but considering the period of custody of the petitioner which is from 10.06.2020 and his relationship with the informant, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Mainatand P.S. Case No. 92 of 2020.
