Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2020 Heard Mr. Hare Ram Singh, learned counsel for the petitioner and Mr. Shakir Ahamad, learned APP for the State.

The petitioner seeks bail in connection with Raghunathpur P. S. Case No. 79 of 2019 dated 08.05.2019, instituted for offences under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. The petitioner and another are said to have given spade blow to one Sujit Pandey, who has received injuries on his head.

The prayer for bail of the petitioner was earlier rejected vide order dated 11.12.2019 passed by a

Patna High Court CR. MISC. No.34554 of 2020(2) dt.22-12-2020 2/2 Bench of this Court in Cr. Misc. No. 56511 of 2019. The petitioner is in custody since 15.07.2019 and the case has only just been committed to the Court of Sessions.

The learned counsel for the petitioner has submitted that there is a land dispute between the parties and the accusation against the petitioner is an off shoot of the aforesaid dispute.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VIII, Siwan, in connection with Raghunathpur P. S. Case No. 79 of 2019.

The petition stands allowed.
