The petitioner has prayed for bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per allegation in the FIR, two miscreants riding on a motorcycle, snatched the bag of the informant containing an amount of Rs. 5 lac, PAN Card, Adhar Card and fled away towards RMK School.

It is submitted by learned counsel for the petitioner that petitioner is innocent has has been falsely implicated in this case on mere suspicion. Petitioner is not named in the FIR. Petitioner has not put on TIP. It is further submitted that similarly situated accused person has been enlarged on bail vide

Patna High Court CR. MISC. No.38095 of 2022(4) dt.04-01-2023 2/2 order dated 19.10.2022 passed in Cr. Misc. No. 41353 of 2022. Petitioner is in custody since 01.12.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Banka P.S.
