JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-04-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Mufassil Police Station Case No. 31 of 2015, disclosing offences under Sections 448, 341, 342, 323, 379, 376, 511 of the Indian Penal Code.
Learned Counsel for the petitioner submits that the police upon completion of investigation have submitted charge sheet, under Sections 354B, 341, 323, 448 of the Indian Penal Code, against the petitioner and his mother and the learned Magistrate has also taken cognizance of the said offence. He has further submitted that Title Suit No. 41 of 2011 brought by the mother of the petitioner against father-in-law of the informant is the reason behind the institution of the present First Information Report,
Patna High Court Cr.Misc. No.14570 of 2016 (2) dt.21-04-2016 2/2 containing false allegation.
However, considering the facts and circumstances, particularly, the fact that the police have already completed investigation, this application is allowed. Let the petitioner, Manish Kumar Paswan @ Mantu @ Manish Kumar, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Munger, in connection with Mufassil Police Station Case No. 31 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
