The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 304B, 201 and 34 of the Indian Penal Code .

It is submitted by learned counsel appearing for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 22.4.2022 (Annexure-1) passed in Cr. Misc. no. 65489 of 2021 giving liberty to the petitioner to renew his prayer for bail after framing of charge. Referring to the order at Annexure-3, it is submitted that charge has been framed against the petitioner in the learned trial court under sections 304/34, 302/34 and 201/34 of the Indian Penal Code. The petitioner is in custody since 14.2.2020 and undertakes to cooperate in the trial.

No.37673 of 2022(2) dt.27-07-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody since 14.2.2020 and charge having been framed in the learned trial court, the petitioner is directed to be enlarged on bail in connection with Sessions Case no. 33 of 2022 (arising out of Tisiauta P.S. Case no. 38 of 2018) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 5th, Vaishali at Hajipur subject to the following conditions:

(I) The petitioner shall remain physically present in court on each date of the trial and (II) In case the petitioner remains absent on any date for reasons not to the satisfaction of the learned trial court or in case the petitioner does not cooperate in the trial, the learned trial court may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial.
