The petitioner apprehends his arrest in Dumra P.S. Case No. 61/2016, registered for the offence punishable under Sections 476, 336, 418 of the Indian Penal Code and Sections 189(c), 27(b)(ii), 18(A), 18(B), 28, 36 of the Drugs and Cosmetics Act. The informant raided the shop of Krishna Kumar and seized different medicines. The informant alleged that Krishna Kumar was running the shop without having valid license. It is submitted that petitioner is a qualified doctor having B.A.M.S. degree and clinic of petitioner is by the side of the shop of Krishna Kumar, but he has also been made accused in the case. Case No. 61/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
