The petitioner is in custody in connection with Anti P.S.Case No.63 of 2018 pending in the Court of learned ACJMVII, Gaya registered for an offence under Sections 302 and 201/34 of the Indian Penal Code.

As per prosecution case, the informant received an information that his daughter, namely, Indrapati has been killed by the accused persons for non-fulfilment of demand of dowry and, furthermore, she had already been cremated without giving any information to the informant and his family members. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case merely on

Patna High Court CR. MISC. No.36095 of 2019(4) dt.23-10-2019 2/2 suspicion. He further submits that petitioner has got clean antecedent and he is in custody since 10.09.2018, chargesheet has already been submitted.

From perusal of the FIR, it is apparent that petitioner is the husband of the deceased and there is specific allegation against this petitioner to cause the death of the deceased. In the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected.
