JUSTICE PRABHAT KUMAR JHA ORAL ORDER 01-02-2021 Mr. Dhurendra Kumar, who appeared on behalf of the petitioners after getting No Objection from Mr. Bimlesh Kumar Pandey, Advocate, undertakes to remove the defects pointed out by the office as soon as regular functioning of the Court starts. The petitioners seek bail in Raxaul Rail P.S. Case No.08 of 2020, registered under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.

The informant Jokhu Mahto named four persons including the two petitioners and alleged that the petitioners and others assaulted him with Belcha and the informant got injuries. Learned counsel for the petitioners submits that from perusal of injury report of Jokhu Mahto, it appears that Jokhu

No.36459 of 2020(3) dt.01-02-2021 2/2 Mahto got as many as three injuries out of which two injuries are incised wound and both the injuries are simple in nature, one abrasion injury caused by hard and blunt object and the same is also simple in nature. Petitioners are in custody since 10.06.2020. There is counter version.

Taking into consideration the facts aforesaid that on account of assault made by the petitioners, simple injuries are caused to the informant and for that the petitioners are in custody since 10.06.2020, petitioners, namely, Kanhai Sah and Rajan Sah are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Magistrate, Bettiah, West Champaran in connection with Raxaul Rail P.S. Case No.08 of 2020.
