The petitioner apprehends his arrest in a case registered for offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.
It is contended that father-in-law of the informant and the father of the petitioner are full brother. As per allegation the informant has got the land in question transferred in his favour from his father-in-law which was allegedly sold by the petitioner to one Ram Kumar Ram who has been granted anticipatory bail by a coordinate Bench of this Court.
Patna High Court Cr.Misc. No.15951 of 2016 (2) dt.23-05-2016 2/2 It is urged that this is a case of civil nature and the petitioner has sold his own share.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Shiv Shankar Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Bochahan P.S. Case No. 133 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate - cum - Sub Judge XI, Muzaffarpur, subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
