1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Vijayepur Police Station Case No. 267 of 2024, disclosing offences under Sections 126(2), 115, 118(1), 109, 303(2), 3(5) of the BNS, 2023.
3. As per the prosecution case, on 01.12.2024 in the morning at about 9-10 am, the petitioner along with other accused persons total 7 in numbers, arrived near the house of the informant having sticks, lathi, iron rod in their hands. Upon seeing the informant, they started assaulting him. When the brother of the informant came to his rescue, the accused persons assaulted and injured him also. It has further been alleged that
Patna High Court CR. MISC. No.36175 of 2025(2) dt.18-06-2025 2/3 petitioner along with Prince Sharma assaulted the informant several times with iron rod on his head due to which informant sustained injury on the head.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to long standing land dispute between the parties who are agnates. A counter case has been lodged by the side of the petitioner against the informant and others having Vijayepur P.S. Case No. 268 of 2024. Learned counsel further submits that allegation in the FIR is that petitioner along with other accused persons assaulted the informant repeatedly but only one injury has been found on the head of the informant which may not be attributable to the petitioner. The petitioner is a lady and privilege of Section 437(2) of the Cr.P.C. may be given to the petitioner.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates having land dispute between them, there is case and counter case and the petitioner is lady, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of

No.36175 of 2025(2) dt.18-06-2025 3/3 her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Vijayepur Police Station Case No. 267 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
