In this case, the petitioner is seeking regular bail in connection with Digha P.S. Case No. 460 of 2019 registered for offence punishable under sections 406, 420 and 506/34 of the Indian Penal Code.

In this case, an agreement was made by four persons, including the present petitioner with the informant for execution of the land, for that, Rs.18,20,000/- was paid to them and as per the prosecution, Rs.4,60,000/- was given to the present petitioner. Learned counsel for the petitioner submits that the petitioner is ready to return the amount of Rs. 4,60,000/- which was given to him.

In view of the statement made at the Bar, this Court grants provisional bail to the petitioner.

Let the petitioner be released on provisional bail on

Patna High Court CR. MISC. No.35132 of 2020(2) dt.08-01-2021 2/2 furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 460 of 2019, subject to the condition that the petitioner will deposit the aforesaid amount in five installments. The 1st installment of Rs.1,00,000/- would be paid to the informant by the petitioner within one month from today and rest amount of Rs. 3,60,000/- must be paid in four installment in the gap of one month, failing which, the provisional bail granted to the petitioner will be treated to have been withdrawn and the police will have liberty to take action against the petitioner in accordance with law.

Further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
