2. The petitioner apprehends his arrest in connection with Pirpainti P.S. Case No. 164 of 2016, registered for the offences punishable under Section 394 of the IPC.

3. It is alleged that in course of proceeding to Amapur from Pakadiya after loading chips, in the way near Manoj Singh's chimney at Laximpur four unknown persons intercepted the informant and his brother-in-law and having tied their hands, legs and mouth, left them in a jungle and took away their tractors.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a bona fide purchaser of the tractor and it was not within the knowledge of the petitioner that the tractor was stolen property. 5. On the other hand, learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJMXI, Bhagalpur in connection with Pirpainti P.S. Case No. 164 of 2016, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
