JUSTICE RAVI RANJAN ORAL ORDER 23-05-2016 It is contended that the petitioner no.1 having been taken into custody, as such, learned counsel does not press this application so far the petitioner no.1 Laxman Singh is concerned. Accordingly, this application is dismissed as not pressed as against the aforesaid petitioner no.1.
Heard parties.
The petitioner nos. 2 to 7 apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 354, 427 and 504 of the Indian Penal Code.
It is contended on behalf of the petitioner nos. 2 to 7 that
Patna High Court Cr.Misc. No.16012 of 2016 (2) dt.23-05-2016 2/2 there is a case and counter case. Admittedly, there is dispute with respect to land between the parties, which would be apparent from the FIR of both the sides itself. It is further contended that all the injuries are simple in nature except one which is grievous in nature on one of the fingers. It is also contended that the injuries are on the petitioners' side also which shows that there was altercation between two sides and the story as set up in the FIR is not correct as nothing has been stated in that regarding the injuries sustained by the petitioners' side.
Having regard to the facts and circumstances of the case, let the petitioner nos. 2 to 7, namely, Dadan Singh, Vishal Singh @ Vishal Kumar Singh, Priyanka Kumari, Sonu Kumari, Satendra Singh and Arjun Singh be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Barauli P.S. Case No.32/2016, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
