JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,323,307,380 and 504/34 of the Indian Penal Code. It is alleged that on the instigation of co accused Bishwanath sah, petitioner no. 1 assaulted the informant with farsa causing bleeding injury on his nose. The accused persons also entered into the house and damaged the property worth Rs.1,00000/- and took out rupees twenty thousand in cash. It is submitted by the learned counsel for the petitioners that for the occurrence of 15.10.2013 the FIR was registered on 24.1.2014 whereas the petitioners' side lodged a case on

Patna High Court Cr.Misc. No.33945 of 2014 (2) dt.02-04-2015 2/2 23.10.2013 for the same occurrence of 15.10.2013. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. More over, there is no injury report on record.

Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Sadar P.S. Case No. 40 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
