JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is stated that petitioner and other accused having conspired with each other got executed sale deed on 15.04.2010 impersonating one Shyam Sundar Gindoria, who had already died on 16.07.2008. It is submitted that petitioner was only witness on the sale deed in question and having similar allegation co-accused Pankaj Kumar has already been granted anticipatory bail by a coordinate Bench of this Court vide order date 11.05.2012 passed in Cr. Misc. No. 16970 of 2012.

Taking note of the facts and circumstances of the case, I do not think it proper to grant privilege of anticipatory bail to the petitioner, accordingly, his prayer for anticipatory bail in

Patna High Court Cr.Misc. No.34589 of 2014 (2) dt.09-04-2015 2/2 connection with Complaint Case no. 1658 of 2010, pending in the court of Sub-Divisional Judicial Magistrate, Araria stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
