2. Petitioner apprehends arrest in a case registered for the offence punishable under section 366A of the Indian Penal Code .
3 . As per prosecution case , the minor daughter of informant had gone missing on 30.06.2022 at about 2.00 pm when she was going to school. It is further alleged that when informant had gone in search of his daughter he got information that this petitioner had kidnapped his daughter.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case . The victim in her statement recorded under Section 164
Patna High Court CR. MISC. No.43308 of 2024(2) dt.20-09-2024 2/2 Cr. P C has denied the prosecution case and has stated that she was in love with this petitioner for the last 2 years and on 1st August 2022, victim on her own will solemnized marriage with this petitioner. The medical Board has assessed the age of victim between 17 to 19 years. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the statement of the victim recorded under Section 164 Cr. P C , clean antecedent of petitioner and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Saran Chapra in connection with Bhagwan Bazar P.S. case No. 336 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
