The petitioner seeks bail in connection with Banka (Barahat) P.S. Case No. 225 of 2019, dated 08.04.2019, instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code.

The Nana of the deceased has lodged the case that

Patna High Court CR. MISC. No.34562 of 2020(3) dt.10-02-2021 2/3 the deceased has committed suicide because of ill-treatment accorded to her and the petitioner and others have cremated the dead-body in stealth.

Learned counsel for the petitioner has submitted that he is the uncle of the deceased.

Though the case was initially instituted for the offence under Section 302 of the I.P.C. but the police, after thorough investigation, found the case to be under Section 306 of the I.P.C. Apart from this, the investigation papers reveal that even the villagers have testified to the fact that the deceased has committed suicide.

The commission of suicide could perhaps be for the bad treatment meted out to her or it could be because of the over sentimentality of the deceased.

There does not appear to be any clear investigation on this point.

The petitioner is stated to be in custody since 23.07.2020.

Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be

No.34562 of 2020(3) dt.10-02-2021 3/3 released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 225 of 2019.
