From the order-sheet dated 12.01.2017, it appears that for the last two dates, nobody appears on behalf of the petitioner, as such the matter was placed today as the last indulgence to the petitioner but today also, nobody appears on behalf of the petitioner.

The matter relates to quashing order dated 24.03.2013 passed in Complaint Case No.2080 of 2012 by Smt. Reshma Verma, Judicial Magistrate Ist Class, Patna, wherein the processes were issued against the petitioner under Section 204 of the Indian Penal Code for the offence under Sections 138 of the Negotiable

Heard learned A.P.P. also, who has pointed out that there is no illegality in the order and the learned court below after perusal of the complaint petition as well as the materials available during the course of enquiry, has issued processes against the petitioner, as such this application is devoid of merit, hence it may be dismissed.

From perusal of the complaint petition, impugned order and materials available on record, it does not appear to be any illegality in the impugned order. Hence, this application is dismissed.
