JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 21.08.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel appearing on behalf of petitioner and learned A.P.P. appearing for the State through video conferencing.

This application is filed for modification of order dated 03.05.2021 passed in Criminal Miscellaneous No. 35718 of 2020.

Learned counsel appearing on behalf of the petitioner submits that petitioner has been granted pre-arrest bail on 03.05.2021 passed in Criminal Miscellaneous No. 35718 of

Patna High Court CR. MISC. No.48045 of 2021(2) dt.15-09-2021 2/2 2020 with a direction to surrender before the court below within a period of four weeks on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise, Siwan, in connection with Basantpur P.S. Case No. 289 of 2020, but, due to some unavoidable circumstances, petitioner could not surrender before the Court below within the stipulated time.

In such view of the matter, let the time to surrender of the petitioner as ordered on 03.05.2021 passed in Criminal Miscellaneous No. 35718 of 2020 be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 03.05.2021 passed in Criminal Miscellaneous No. 35718 of 2020 is modified to the above extent.

This application stands disposed of.
