2. Heard Mr. Ashhar Mustafa, learned counsel for the petitioner and Mr. Kalyan Shankar, learned Additional Public Prosecutor (hereinafter referred to as the 'APP') for the State.

3. The petitioner was in custody in connection with S. Tr. No. 95 of 2020 arising out of Kopa PS Case No. 11 of 2019 dated 19.01.2019 instituted under Sections 302/34 of the Indian Penal Code had moved the Court in the present case for bail.

4. As this was the second attempt for bail since earlier such prayer was rejected by order dated 11.12.2019 passed in Cr. Misc. No. 45371 of 2019, by order dated 23.06.2021, a fresh report was called from the trial Court. In terms thereof, a report has been submitted by learned ADJ-5, Saran dated 30.07.2021, in

Patna High Court CR. MISC. No.37889 of 2020 dt.04-08-2021 2/2 which it has been stated that he has disposed of the trial on that day and the petitioner has been acquitted and, thus, release order in his favour has been issued.

5. Having regard to the aforesaid, nothing further remains in the present petition and accordingly, the same stands disposed of.
