JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

Accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that for the occurrence of 12.04.2014, the F.I.R. was registered on 10.07.2014 whereas Paharpur P.S. Case No. 219 of 2014 was registered on 08.09.2014 under section 363/366A/34 of the Indian Penal Code against the petitioner in which the victim was examined under section 164 of the Cr.P.C. wherein she got her age recorded as 18 years but as per medical opinion the age of victim

Patna High Court Cr.Misc. No.14780 of 2015 (2) dt.13-04-2015 2/2 has been assessed between 17 1⁄2 to 18 1⁄2 years. The victim sated under 164 statement that she has married with the petitioner on her own will. It is further submitted by learned counsel for the petitioner that the victim has also filed a petition before the learned court below on 13.01.2015 to the effect that she is residing with the petitioner as his wife.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Paharpur P.S. Case No.143 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
