2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 147, 148, 149, 342, 323, 325, 307, 354(b), 379, 504 and 506 of the Indian Penal Code.
3. It is alleged that the husband of the informant was beaten by the petitioners which caused serious injuries to his back bone.
4. Learned counsel for the petitioners submits that F.I.R has been lodged after inordinate delay of six months without any explanation which renders the entire prosecution
Patna High Court CR. MISC. No.42292 of 2023(2) dt.31-07-2023 2/2 doubtful. The doctor has found the injury simple. Petitioner claims clean antecedent.
5. Considering the inordinate delay in lodging the F.I.R and clean antecedent, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of Miss Swati Singh, J.M. 1st Class Gaya in connection with Magadh Medical P.S. Case No. 285/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
