The petitioner is apprehending his arrest in connection with SC/ST (Bhabua) P.S. Case No.30 of 2015 for the offences instituted under Sections 341, 323, 354, 504, 506 of the Indian Penal Code and Section 3(1)(x)(xi) of the SC/ST Act.. The prosecution case, in brief, is that the accused persons turned up in the 12 noon while the informant was constructing a hut over his land, started assaulting him with leg, fists and Danta, his other family members also turned up hearing the alarm raised by him they too were assaulted. It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. All the sections are

Patna High Court Cr.Misc. No.15808 of 2016 (2) dt.16-05-2016 2/2 bailable. As far as Section 354 I.P.C. is concerned, same is not made out, nor any offence under SC/ST Act, is attracted against the petitioner. The other co-accused have been granted anticipatory bail vide Cr. Misc. No.16556 of 2016. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, Judicial Magistrate, 1st Class, Kaimur at Bhabua, in connection with SC/ST (Bhabua) P.S. Case No.30 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
