The petitioner seeks bail in Hathauri P.S. Case No.37 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is the driver of the truck and he was not knowing about the consignment kept inside the truck but it appears that the informant got specific inputs about carrying of huge quantity of liquor in a truck. On such, the truck was intercepted and 2395 litres of liquor was recovered from the truck. Considering the facts of recovery of huge quantity of liquor from the truck and the petitioner is the driver of the truck, I am not inclined to enlarge the petitioner on bail. Accordingly,

Patna High Court CR. MISC. No.34347 of 2020(2) dt.12-01-2021 2/2 the prayer for bail of the petitioner is rejected. Since the petitioner is in custody since 14.03.2020, the learned trial court is directed to expedite the trial and conclude the same within six months from the date of receipt of this order.

The Superintendent of Police, Samastipur is directed to ensure the presence of the witnesses in the trial court so that the trial must be concluded within six months. Let a copy of this order be sent to the learned trial court as well as the Superintendent of Police, Samastipur for information and needful.
