The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379, 420 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that the truck which was seized for overloading of sand was forcefully taken away by the petitioner who is owner of the truck.

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that the date of occurrence is 16.02.2022 and the F.I.R. came to be instituted on 22.02.2022, learned counsel draws the

No.38482 of 2022(2) dt.22-08-2022 2/2 attention of the Court to Annexure '2' to the anticipatory bail application to submit that from perusal of the owner book of the truck it would manifest that the truck belongs to one Ramadhar Singh and not to the petitioner, it is also submitted that previous owner of the truck was Amit Kumar, learned counsel thus submits that it appears that in haste the present F.I.R. came to be instituted even without verifying the facts correctly. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Lakhisarai (Kabaiya) P.S. Case No. 158 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
