JUSTICE MUNGESHWAR SAHOO ORAL ORDER 03-08-2016 Heard the learned counsel, Mr. Nafisuzzoha, for the petitioner and the learned counsel, Mr. Anand Kumar Ojha, for the respondent.

Perused the order dated 10.03.2016 passed by Sub Judge, Baisi, Purnea in Title Suit No.258 of 1997.

The plaintiff petitioner filed suit for partition. In the said suit for partition, the application has been filed for appointment of pleader commissioner. By the impugned order the Court below after considering the entire materials fact held that appointment of pleader commissioner is not required.

From perusal of the impugned order, it appears that the Court below has considered all the aspects of the matter. The order is not irrational nor it can be said that the Court below has no jurisdiction to pass the order nor it can be said that the order passed by the Court below is in the manner not permitted by law.

Patna High Court C.Misc. No.96 of 2016 (2) dt.03-08-2016 2/2 Accordingly, I find no reason to interfere with the impugned order.
