The petitioner is in custody in connection with Fulkaha P.S. Case No.40 of 2019, corresponding to Special Case No.390 of 2019, registered for the offences punishable under Sections 30 (a), 41(I) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case 35.1 litres liquor was recovered. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 18.03.2019.

Considering the facts that petitioner has no criminal antecedent, let the petitioner, above named, be released on bail
