The petitioner, who is in custody since 01.08.2020, seeks bail in connection with POCSO Case No. 45 of 2020 arising out of Mahila Dehri P.S. Case No. 34 of 2020, dated 29.07.2020, instituted for the offences under Sections 354 and 354(B) of the Indian Penal Code and Sections 8 and 12

Patna High Court CR. MISC. No.35069 of 2020(3) dt.03-02-2021 2/3 of the Protection of Children from Sexual Offences Act, 2012.

The allegation against the petitioner is of pulling down the trouser of the victim girl.

Learned counsel for the petitioner has drawn the attention of this Court to the fact that two of the pupils of the petitioner have stated that the victim girl was made to sit alone as she had not done her homework. It has, therefore, been submitted that as a revenge of the aforesaid treatment given to the victim, the present case has been lodged. In any view of the matter, regard being had to the period of custody of the petitioner which is from 01.08.2020, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Exclusive Special Court, POCSO, Rohtas at Sasaram in connection with POCSO Case No. 45 of 2020 arising out of Mahila Dehri P.S. Case No. 34 of 2020.

It is made clear that the petitioner shall participate
