JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barauli P.S. Case No. 57 of 2019, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. It is alleged that 4164.48 litres of foreign liquor from a Truck and 129.60 litres of foreign liquor from a white Scorpio Vehicle were recovered and three persons including this petitioner were apprehended by the police.

It is submitted on behalf of petitioner that petitioner is Driver of the aforesaid Truck. Petitioner has no concern with the seized liquor. Other co-accused has been granted bail by a Coordinate Bench of this court vide order dated 10.06.2019 passed in Cr. Misc. No. 36224 of 2019. Petitioner is in custody since 23.03.2019 having no criminal antecedent.
