JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-03-2022 Heard Mr. Shivendra Kumar Singh, learned counsel for the petitioner and Mr. Vinod Shankar Modi, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Dhansoi P.S. Case No. 93 of 2021 registered for the offences punishable under Sections 467, 468, 420 and 120(B)/34 of the Indian Penal Code 1860.

The allegation, as per the First Information Report, is that the petitioner in connivance with the official of the Circle Officer and the Computer Operator has got the entry of a piece of land situated at Plot No. 491, Khata No. 84, having an area of 0.62 Acre, done in the computer

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case by the informant with oblique motive inasmuch as the petitioner is the son of Lalan Khahar in whose favour the land in question was settled by the District Magistrate, Buxar, in Settlement Case No. 31/1978-89 dated 2.3.1978. Thus, the submission is that the petitioner has got bona fide claim upon the subject land, and on the basis of settlement of the land made in favour of the father of the petitioner, in the computer record, the name of the petitioner has been included. The petitioner is in custody since 29.6.2021 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record and a copy of the order-sheet dated 2.3.1978 passed by the Settlement Officer at Annexure-2, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like
