The petitioner is in custody in connection with Jogbani P.S. Case No.73 of 2019 corresponding to Special Case No.378 of 2019 for the offences under Sections 30(a) & 38(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner and he is in custody since 16.03.2019. He further submits that in the instant case total 19 liters of cough syrup and Rs.13,000/- were seized.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is

Patna High Court CR. MISC. No.34995 of 2019(2) dt.28-05-2019 2/2 directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria, in connection with Jogbani P.S. Case No.73 of 2019 corresponding to Special Case No.378 of 2019.
