====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-01-2022 Heard learned Advocate for the petitioners and learned APP for the State.

The petitioners seek bail in connection with Khagaria (Mufasil) P. S. Case No.489 of 2021, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 325, 429, 379, 504, 506, 337 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioners submits that the petitioners are in custody since 24.06.2021 and charge-sheet has been submitted in this case.

From perusal of the allegation as alleged in the F.I.R., it would manifest that petitioners have not been alleged to be the

No.47624 of 2021(2) dt.17-01-2022 2/2 assailants rather it is alleged that while fleeing, the petitioners snatched golden chain from the son of the informant and also brick-batted and damaged the room of the informant. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody since 24.06.2021, charge-sheet has been submitted in this case and petitioners are not alleged to have assaulted the informant, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P. S. Case No.489 of 2021.

The application stands allowed.
