The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307, 147, 148, 149, 448, 323, 504, 506, 380 of the Indian Penal Code. It is alleged that the accused persons after forming an unlawful assembly assaulted the informant by means of farsa, rod and khanti and in course of occurrence Md. Mithe and Md. Kutubddin took away attaché containing Rs.25,000/- cash and one Nokia Mobile from the house of the informant. It is submitted by learned counsel for the petitioners that the two injuries found on the person of the informant but the same is simple in nature. There is counter version of the
Patna High Court Cr.Misc. No.12754 of 2015 (2) dt.26-03-2015 2/2 occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.S. Case No.52 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
