JUSTICE MADHURESH PRASAD ORAL ORDER 10-08-2022 Heard learned counsel for the petitioner and learned counsel for the State The petitioner seeks bail in Madanpur P.S. Case No. 45 of 2020, instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon to do so by the office. The prayer for bail of the petitioner was earlier rejected on 05-03-2021. This Court, while rejecting the prayer for bail, has taken into consideration the fact that the motive assigned against the petitioner being illicit relation of the
Patna High Court CR. MISC. No.47226 of 2021(13) dt.10-08-2022 2/2 petitioner with the sister of deceased was found to be substantiated during the course of investigation. The prayer has been renewed by filing the instant bail application. This Court would further take note of the fact that he has remained in custody since 04-06-2020.The Trial Court has reported that after framing of the charges in April, 2022, the matter is now fixed for recording of evidence. Since the evidence has already started in April, this Court, for the present, having regard to the material collected during the course of investigation, and seriousness of the allegations, is not inclined to take a different view.
The bail petition is rejected.
