Deceased Anil who came out from his house in the night of 3-4/07/2013 did not return. Accordingly, search was made and his dead body was found over railway track having ante mortem injury over his dead body.

From perusal of the case diary, it is apparent that none is an eye witness to occurrence. Name of petitioner along with Bauwa cropped up during course of supervision and subsequently thereof, the witnesses have simply shown suspicion. Moreover, Bauwa Yadav had already been granted anticipatory bail vide Cr. Misc. No.24024 of 2014.

Accordingly, petitioner Shankar Yadav is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Saharsa in

Patna High Court Cr.Misc. No.34709 of 2014 (3) dt.28-04-2015 connection with Saharsa P.S. Case No.325 of 2013 in the event of his arrest / surrender within four weeks in terms of condition so laid down under Section 438(2) Cr.P.C.
